METRO AG files appeal against German Cartel Office decision
In a decision as at 26 February 1999, and following months of analysis, the German Cartel Office has declared the retroactive harmonization of purchasing conditions for METRO AG in relation to its acquisition of the allkauf Group, Mönchengladbach, concerning 20 medium- and small-scale suppliers as not permissible.
The purchasing conditions had been made retroactive to include the time period before permission was granted by the German Cartel Office to METRO AG for the acquisition of the allkauf Group. METRO AG will file an appeal against the decision on both factual and formal grounds.
Because the German Cartel Office already assumes that medium-scale suppliers are dependant on large retail and trade companies if a large group represents a proportion to total goods supplied which exceeds 7.5%, large retail trade companies will have to consider the resulting consequences of this decision.
Only if the proportion to total goods supplied by the small- and medium-scale company to a specific retail trade company is below the level established by the German Cartel Office are there no grounds for dispute.
